Please read these Terms of Use and Terms and Conditions ("Terms") carefully before using the Wildlife SOS India Foundation Booking Engine platform ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Parties
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Wildlife SOS India Foundation, a Section 8 Company incorporated under the Companies Act, 2013, with its registered office at D-210, Defence Colony, New Delhi – 110024, India ("Foundation", "we", "us", or "our").
2. Eligibility
- You must be at least 18 years of age to use this Platform independently.
- Bookings for minors must be made by a parent or legal guardian, who accepts full responsibility.
- By using this Platform, you represent that the information you provide is accurate, complete, and current.
3. Services Offered
The Platform enables users to book and register for:
- Conservation centre visits and guided tours
- Educational and wildlife awareness programs
- Wilderness First Aid and capacity-building training programs
- Purchase of merchandise, where available
- Any other programs or services as listed on the Platform from time to time
4. Bookings & Payments
4.1 Booking Confirmation
A booking is confirmed only upon receipt of full payment and issuance of a confirmation email to your registered email address. The Foundation reserves the right to cancel any booking at its sole discretion with a full refund in the event of unavoidable operational circumstances.
4.2 Pricing & GST
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless otherwise stated. Wildlife SOS India Foundation is a GST-registered entity.
4.3 Payment Gateway
Payments are processed through a third-party payment gateway. The Foundation does not store your payment card details. Transactions are encrypted and processed in compliance with applicable security standards.
In the event of a payment failure, please do not attempt multiple re-submissions before confirming the status with our support team.
4.4 Invoices & Receipts
Tax invoices for all bookings will be issued in the name of Wildlife SOS India Foundation. These are service receipts and are not charitable donation receipts.
5. Cancellations & Refunds
5.1 Cancellation by User
- Cancellations made 7 or more days prior to the scheduled date of the program/visit shall be eligible for a full refund, less any applicable transaction or processing fees.
- Cancellations made between 3 and 6 days prior to the scheduled date shall be eligible for a 50% refund.
- Cancellations made within 48 hours of the scheduled program/visit are non-refundable.
5.2 Cancellation by Foundation
In the event the Foundation cancels a booking due to force majeure, operational constraints, safety concerns, or government directives, a full refund shall be issued within 7 working days of cancellation.
The Foundation shall not be liable for any additional compensation.
5.3 No-Show Policy
Failure to attend a booked program without prior cancellation will be treated as a no-show, and no refund will be issued.
6. User Conduct
By using the Platform and attending programs at our conservation centres, you agree to:
- Comply with all safety instructions and guidelines provided by Foundation staff
- Treat all animals, staff, and fellow visitors with respect and dignity
- Refrain from any conduct that may endanger animals, staff, or other visitors
- Not engage in unauthorized photography or commercial use of content without prior written approval
- Not share access to your booking confirmation with any person other than those registered for the booking
7. Intellectual Property
All content on this Platform, including but not limited to text, graphics, logos, photographs, and educational materials, is the property of Wildlife SOS India Foundation or Wildlife SOS and is protected under applicable intellectual property laws.
You may not reproduce, distribute, or commercially exploit any content from this Platform without prior written consent from the Foundation.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform or participation in any program.
The Foundation’s total aggregate liability for any claim arising under these Terms shall not exceed the amount paid by you for the relevant booking.
9. Indemnification
You agree to indemnify, defend, and hold harmless Wildlife SOS India Foundation, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Your violation of any applicable law or third-party rights
- Your conduct during programs or at conservation centre premises
10. Force Majeure
The Foundation shall not be liable for any delay or failure to perform its obligations under these Terms resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, government directives, civil unrest, or acts of God.
11. Modifications to Terms
The Foundation reserves the right to amend these Terms at any time. Revised Terms will be posted on the Platform with an updated effective date. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation. Failing resolution, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in New Delhi in the English language.
